COLLECTIVE BARGAINING AGREEMENT

FEDERALE 1

YOUR WORK CONTRACT

ARE THERE ANY RESTRICTIONS ON THE LENGTH OF MY EMPLOYMENT CONTRACT ?

Yes, your contract with the club cannot extend over 5 consecutive years. The season begins on July 1st and ends on June 30th of the season that the contract expires on.
Termination must be set for June 30th during the season in which the contract expires.

WHEN EXACTLY DOES MY CONTRACT COME INTO EFFECT ?

Your employment contract starts from the date indicated on it. You can’t participate in any official competition until your contract is registered by the FFR.

DOES MY CONTRACT HAVE TO BE APPROVED BY THE FFR ?

Yes. Any employment contract between a club and a player must be approved by the FFR. Otherwise, the contract is thought to be null.

WHAT HAPPENS IF MY CONTRACT IS NOT VALIDATED BY THE FFR?

If your contract is not registered by the FFR you can’t participate in an official game but you can practice with the team.

DOES MY CONTRACT HAVE TO BE APPROVED BY THE FFR ?

As soon as your contract is certified by the FFR you will be qualified to play.

HOW MY WORKING HOURS ARE CALCULATED ?

A professional rugby player is in principle a full-time worker. That means 35 hours/week.

Your working time includes:

  • Training (individual or collective)
  • Fitness sessions imposed by the coach – Matches (championship or friendly matches)
  • Promotional and/or commercial and/or demonstration (school) actions
  • Traveling for away matches
  • Team meals after a match
  • The time spent with the medical staff (physician, physiotherapist, etc.)
  • Video analysis sessions

AM I ENTITLED TO A MINIMUM REST PERIOD BETWEEN TWO DAYS OF WORK ?

Yes. you are entitled to 11 hours of consecutive rest.

AM I ENTITLED TO A MINIMUM BREAK DURING A WEEK OF WORK ?

A professional rugby player is in principle a full-time worker. That means 35 hours/week.

CAN I SIGN A PART-TIME CONTRACT ?

Yes, your part-time contract must be of at least 17,5 hours per week.

CAN I ADD AN UNEMPLOYMENT ALLOWANCE TO MY MONTHLY SALARY?

Yes! If you have not used all your unemployment benefits, they can be added to your monthly salary. However, the money and your new salary can’t make up for more than what you were earning before.

CAN THE CLUB TERMINATE MY CONTRACT BEFORE THE END OF THE SEASON ?

Yes, it is possible, but in this case, your employer must pay the remaining salaries until the end of the contract.

CAN I TERMINATE MY CONTRACT BEFORE THE IT ENDS ?

Yes, but you will have to pay to the club the remaining salaries you would have had received until the end of your contract. The contract can also be terminated by agreement of the parties (you and the club): this agreement must be formalized by the conclusion of an addendum. Be careful, if you are at the initiative of the termination, you will not receive unemployment benefits for a certain period.

AM I ELIGIBLE FOR "POLE EMPLOI" BENFITS AT THE END OF MY CONTRACT ?

Yes. At the end of your contract, you may be eligible to receive a Pole Emploi (unemployment) allowance (A.R.E).

DISCIPLINARY PROCEDURES

CAN I BE CALLED BY THE FFR DISCIPLINARY COMMISSION ?

Yes, you can be called and potentially sanctioned if you have not respected the rules and regulation of the FFR. In case of a sanction, you can appeal in front of the appeal chamber of the federation.

 

MY TEAM IS ASKING ME NOT TO COME TO PRACTICES, TEAM ACTIVITIES OR ASKS ME TO TRAIN ALONE, CAN THEY DO THAT?

No, the club cannot ask you to no longer train with the team.

WHAT IS A PROVISIONAL SUSPENSION ?

The provisional suspension is not a sanction but it doesn’t allow you to work (going to game or practice) for a certain period. Also note that your employer can decide not to pay you during this period, it’s legal.

SALARY

WHAT IS THE MINIMUM WAGE WHEN I SIGN MY FIRST PROFESSIONAL CONTRACT?

The minimum wage is 18.600 euros gross for a sporting season.

WHEN SHOULD I COLLECT THE BONUSES AGREED IN MY CONTRACT ?

Your bonuses should be paid no later than after the end of the sporting season.

WHAT CAN I DO IF MY CLUB DOES NOT PAY MY MONTHLY SALARY ?

You have 3 years after the end of your contract to claim your missing salaries. We strongly advise you to contact the FFR legal commission by certified mail to inform them of any procedure you might intend against the club. If within 30 days you still have not received your missing salaries you can request a transfer to another team with the approval of the FFR legal commission.

WHEN SHOULD I RECEIVE MY SALARY ?

The club can pay your wage until the 10th of each month.

IMAGE RIGHTS

THE CLUBS ASK ME TO PARTICIPATE IN TEAM ACTIVITIES THAT INCLUDE SPONSORS OR KIDS IN SCHOOLS, SHOULD I GO?

Yes, you must participate in teams activities and any other promotional activities but the club must inform you at least 6 days in advance. You can refuse to participate but you have to provide an “in writing” reason why you’re not willing to participate.

YOUTH PLAYERS

I'M WITH THE YOUTH TEAM CAN I HAVE A SALARY ?

Yes but you must have a contract. Alone your convention with the club is not sufficient to receive a salary but it can pay for your expenses (housing, food)

IF THE CLUB LOSES ITS AGREEMENT WHAT HAPPENS WITH MY "CONVENTION"?

Yes, you can but it must be notified to the club in writing and it will come into force after 30 days. This situation may lead to the payment of training compensation when you sign with another professional team.

CAN THE CLUB TERMINATE MY TRAINING CONVENTION ?

Yes but the club must send you a certified letter at least 30 days before the end of the sporting season. If for some reason you have not signed a contract or a training convention with the next 3 months, the club must allow you to finish school the year after or offers you a job opportunity outside of rugby.

CAN I TERMINATE MY TRAINING CONVENTION ?

Yes, you can terminate your convention but it must be notified to your club in writing (certified letter). There is a 30 days delay before it becomes official.

VACATION, BREAKS AND NATIONAL TEAMS

HOW MANY DAYS OF VACATION DO YOU HAVE DURING THE SEAON?

3,5 days every month when you have worked for your employer. You can’t freely decide to take your vacation at a certain time of the year you must refer to your employer to set the date up.

DO I HAVE A BREAK AROUND CHRISTMAS

Yes, for federal 1 players the breaks are collectively negotiated by Provale. They are more likely equal to 15 consecutive days.

I'M SELECTED TO PLAY WITH MY NATIONAL TEAM DOES IT CHANGE MY RELATIONSHIP WITH MY EMPLOYER ?

It has no influence whatsoever on your working contract. You benefit from the same rights as an employee of your club and also your club must let you go play for your national team.

CAN I BENEFIT FROM A CHILD BIRTH AND PATERNITY LEAVE ?

Yes, you can benefit from a childbirth leave of 3 consecutive days. You’re paid during that period. It can’t be taken whenever you want. You can benefit from an 11 days paternity leave or 18 consecutive days in case of multiple children. During this period you will not be paid. You must inform your employer at least one month in advance

DO I HAVE A VACATION PERIOD AFTER THE LAST OFFICIAL GAME OF THE SEASON?

Yes, after your last official game of the season you must benefit from 4 consecutive weeks of rest without returning to your team.

HEALTH AND INSURANCE BENEFITS

HOW LONG DO I HAVE TO UNDERGO ALL THE MANDATORY MEDICAL EXAMS WITH THE CLUB?

You must undergo all the medical exams as soon as you arrive at the club. You will only be able to practice after completing these medical exams.

WHAT HAPPENS IN CASE OF AN INJURY ?

During the first 28 days, your club will complete the amount of daily social security allowances, which will allow you to fully maintain your remuneration.

On the 29th days: you will benefit from the collective agreement benefits. Those amount of benefits are capped at 80% of your gross remuneration monthly and at 2 times the ceiling of social security contributions (6538 euros gross monthly in 2018).

If your salary is higher than 6538 euros gross per month, you should consider taking a personal insurance on top of the collective agreement insurance.

IF I AM SERIOUSLY INJURED DURING THE SEASON AND HAVE TO STOP PLAYING RUGBY WHAT HAPPENS ? DO I GET ANY MONEY?

The collective agreement offers you specific insurance provision if you can no longer work as a professional rugby player. You will receive benefits according to your age and the age groups are as follows:

  • Players under 25 years of age: 80 % of your gross salary paid for 24 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 100 000 € max.
  • Players from 25 to 27 years of age 80 % of your gross salary paid for 18 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 75 000 € max.
  • Players from 28 to 30 years of age 80 % of your gross salary payed for 12 months as soon as you have been declared ineligible to play for medical reason by the social security doctor. The amount you will receive can be up to 50 000 € max.
  • Players from 31 to 32 years of age 80 % of your gross salary paid for 9 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 40 000 € max.
  • Players from 33 to 34 years of age 80 % of your gross salary paid for 6 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 30 000 € max.

IF I DIE, WILL MY FAMILY BE ENTITLED TO AN INSURANCE PAYMENT ?

Yes, your family will benefit from an amount that is equal to 100% of your annual gross salary. It will automatically increase by 50% is you were married at the time and will also automatically increase of another 50% for each of the children you are responsible for.

RECRUITING AND TRANSFER RULES

AS A TOP 14 OR PRO D2 PLAYERS WHAT ARE THE CONDITIONS FOR ME TO PLAY IN FEDERAL 1?

If you have participated in the competition organized by the FFR you must follow certain conditions: having a full-time professional contract with the team or a professional contract where you are making at least 1000€ gross per month and the proof that you have another activity on the side.

I HAVE AN ESPOIR CONTRACT, UNDER WHITCH CONDITION CAN I GO PLAYER EN FEDERAL 1

If you have participated, in LNR competition with a junior contract (Espoir) you must meet certain criteria to play for a federal 1 team :

  • must have at least a part-time contract
  • must have a part-time contract as professional player and another part-time contract as proof of your employment.

CAN I SIGN A CONTRACT IN TOP 14 OR PRO D2 AFTER STARTING THE SEASON FOR A TEAM PLAYING IN FEDERAL 1

Yes, if you’re playing in federal 1 you can sign with no other conditions for a club in TOP 14 or Pro D2

CAN I BE LEASED IN TOP 14 OR PRO D2 CLUB WITHIN THE SAME SEASON ?

No

IF I EARN MORE THAN 1000 EUROS PER MONTH CAN I RESIGN A CONTRACT IN FEDERAL 1 NEXT SEASON?

Yes. you can sign a new contract for another federal 1 team under 2 conditions  

  • a federal 1 contract for at least 1000€ gross per month ;
  • a full time or part time working contract on the side.

DUAL CAREER AND TRANSITION

WHAT ARE MY RIGHTS AS AN EMPLOYEE IF I WANT TO PREPARE MY LIFE AFTER RUGBY?

You’re eligible to benefit from all the resources offered by your working contract. It means having classes or courses paid by your employer.
