THE COLLECTIVE AGREEMENT

LNR

YOUR WORK CONTRACT

ARE THERE ANY RESTRICTIONS ON THE LENGTH OF MY EMPLOYMENT CONTRACT ?

Yes, your contract with the club cannot extend over 5 consecutive years. Termination must be set for June 30th during the season in which the contract expires.

WHEN EXACTLY DOES MY CONTRACT TAKE EFFECT ?

Your employment contract starts from the date indicated on it, on condition that this contract has been approved by the LNR (a contract which is not approved is thought to be nullified !). However as soon as you have started to execute your contract ( training , benefits in kind …) it comes into effect

DOES MY CONTRACT HAVE LNR APPROVAL ?

Yes. All employment contracts between a club and a player must be approved by the LNR. Otherwise, the contract is thought to be nullified.

WHAT DOCUMENTS ARE NEEDED FOR THE LNR TO REGISTER MY CONTRACT ?

  • A copy of your contract and the amendments
  • The “release letter, if you come from a foreign country.
  • The medical certificate established by the club’s doctor.
  • If you’re from of an EU Member State or from the European Economic Area: a valid identity document.
  • If you’re not a national of these countries: a valid official identity document, a residence permit, and a work permit.
  • The agent’s contract with the club

WHAT HAPPENS IF MY CONTRACT IS NOT APPROVED BY THE LNR ?

If your contract is not approved by the LNR, the club must inform you within 48 hours :

  • In case of refusal linked to financial reasons, the contract is still valid but you can not participate in any official activities with the club
  • In case of refusal for another reason: your contract is considered as in-valid.

ARE THERE APPEALS TO DISPUTE THE REFUSAL OF CERTIFICATION OF MY CONTRACT?

Yes but you have 15 days to do so by providing any missing documents to the LNR. In case of a doubt you can contact Provale for additional support and also request an evaluation of your case by the LNR legal commission

WHEN AM I ALLOWED TO COMPETE WITH MY CLUB ?

As soon as your contract has been approved by the LNR, you are qualified and can participate in the team activities (games or training)

HOW ARE MY WORKING HOURS CALCULATED ?

A professional rugby player is in principle a full-time worker. This means 35 hours/week.

Your working time includes:

  • Training (individual or collective)
  • Fitness sessions imposed by the coach
  • Matches (championship or friendly matches)
  • Promotional and/or commercial and/or demonstration (school) activities
  • Travelling for away matches
  • Team meals after a match
  • The time spent with the medical staff (physician, physiotherapist, etc.)
  • Video analysis sessions

AM I ENTITLED TO A MINIMUM REST PERIOD BETWEEN TWO DAYS OF WORK?

Yes! you are entitled to a break of 11 consecutive hours between 2 working days, or 9 hours after an away game.

AM I ENTITLED TO A MINIMUM BREAK DURING A WEEK OF WORK?

Yes, you are entitled to a minimum of one day off per week that should last for at least 35 consecutive hours. It can be reduced to 33 consecutive hours in case of an away game.

CAN I SIGN A PART-TIME CONTRACT ?

Yes, but the part-time contract must necessarily for a minimum of 24 hours per week

CAN I INCLUDE IN MY SALARY A "POLE EMPLOI" ALLOWANCE?

Yes! If you have not used all your unemployment benefits, they can be added to your monthly salary. However, the money and your new salary can’t make up more than what you were earning before.

CAN THE CLUB TERMINATE MY CONTRACT BEFORE THE END OF THE SEASON ?

Yes, it is possible, but in this case, your employer must pay the remaining salaries until the end of the contract.

CAN I TERMINATE MY CONTRACT BEFORE IT ENDS ?

Yes, but you will have to pay to the club the remaining salaries you would have had received until the end of your contract. The contract can also be terminated by agreement of both parties : this agreement must be formalized by the conclusion of an amendment sent to the “legal Commission” of the LNR. Be careful, if you initiate the termination yourself, you will not receive unemployment benefits for a certain period.

AM I ELIGIBLE FOR "POLE EMPLOI" BENEFIT AT THE END OF MY CONTRACT?

Yes. At the end of your contract, you may be eligible to receive a Pole Emploi (unemployment) allowance (A.R.E).

However, ARE payment is subject to several conditions:

  • Must be living in France.
  • Currently and continuously looking for work.
  • Having involuntarily lost your job. (Resignation does not entitle you to unemployment rights straight-away)
  • Having worked at least 88 days or 610 hours
  • Must be looking for a job.

DISCIPLINARY PROCEEDINGS

CAN I BE CALLED BY THE LNR DISCIPLINARY COMMISSION?

Yes, you can be called and potentially sanctioned for any acts not considered fair play or if you have not respected the rules and regulation of the LNR. In case of a sanction, you can appeal before the appeal committee of the federation. You have a 7 day period to do so as from notification of the decision . Be careful, the appeal DOES NOT suspend the decision. Sanctions can range from a simple disciplinary warning to loss of membership.

 

MY TEAM IS ASK ME NOT TO COME TO PRACTICES, TEAM ACTIVITIES OR ASKS ME TO TRAIN ALONE, CAN THEY DO THAT?

No, the club cannot ask you to no longer train with the team.

WHAT IS A PROVISIONAL SUSPENSION?

The provisional suspension is not a sanction but it doesn’t allow you to work (going to games or practices or taking part in any club events ) for a certain period. Also, note that your employer can decide not to pay you during this period, it’s legal.

SALARY

WHAT IS THE MINIMUM SALARY WHEN I SIGN MY FIRST PROFESSIONAL CONTRACT?

It’s equal to the minimum salary of the collective agreement :

  • For Top 14 : 42.000 € gross annually
  • For Pro D2: 23.000 € gross annually

IS THERE A MINIMUM SALARY FOR TOP 14 AND PRO D2 PLAYERS ?

It’s equal to the minimum salary of the collective agreement :

  • For Top 14 : €42.000 gross annually
  • For Pro D2: €23.000 gross annually

WHEN SHOULD I COLLECT THE BONUSES AGREED IN MY CONTRACT ?

Your bonuses related to the matches you played and club results should be paid no later than after the end of the sporting season.

WHAT HAPPENS IF THE CLUB DOESN'T PAY MY SALARY, ALLOWANCES OR MY BONUSES?

You have 3 years after the end of your contract to claim your missing salaries. We strongly advise you to contact the LNR legal commission by registered letter to inform them of any procedure you might intend to take against the club. If within 30 days you still have not received your missing salaries you can request a transfer to another team with the approval of the LNR legal commission.

WHEN SHOULD I RECEIVE MY SALARY ?

The club can pay your salary until the 10th of each month.

IMAGE RIGHTS

CAN I FREELY USE MY PERSONAL IMAGE ?

Yes, but it must not refer to the club activities unless they grant you the permission to use their image. You must inform them in writing by registered letter. Be careful the club may not allow you to use your image with a sponsor that is not already a sponsor of the club. (they should provide you with a full list of their sponsors at the beginning of the season)

CAN THE LNR USE MY PERSONAL IMAGE FOR ITS OWN BENEFIT ?

Yes, the LNR can use your image across the world for 10 years for any type of promotional or commercial activities. If the LNR decides to do more with your image, they must ask for your express consent.

THE CLUB ASKS ME TO PARTICIPATE IN TEAM ACTIVITIES THAT INCLUDE SPONSORS OR KIDS IN SCHOOLS, SHOULD I GO?

Yes, you must participate in teams activities and any other promotional activities but the club must inform you at least 6 days in advance. You can refuse to participate but you have to provide an “in writing” reason why you’re not willing to participate.

CAN THE CLUB USE MY PERSONAL IMAGE FOR ITS OWN BENEFIT?

Yes, the club can use my personal image for its benefits to promote the club’s activities and the competitions they are participating in. They can also commercialize my image on goodies. This should be written in your contract otherwise they should request your express consent.

YOUTH PLAYERS

I'M WITH THE YOUTH TEAM. CAN I HAVE A SALARY ?

Yes, it’s possible but you need to have an “espoir” contract. The training agreement alone can’t grant you financial compensation but it can take into account benefits in kind.

I'M A YOUTH PLAYER IS THERE A MINIMUM SALARY ?

Yes, if you’re in TOP14 €26.000 gross per season and if you’re in Pro D2 €23.000 gross per season

I HAVE AN ESPOIR CONTRACT AND I HAVE PLAYED SOME GAMES WITH THE PROFESSIONAL SQUAD AM I ENTITLED TO BONUSES?

Yes, you can have bonuses on top of your salary. Since the calculation is complex please contact Provale to seek any assistance you may need

IF THE CLUB LOSES ITS AGREEMENT TO HAVE A YOUTH TEAM WHAT HAPPENS ?

Yes you can but it must be notified to the club in writing and it will come into force after 30 days. This situation may lead to the payment of training compensation when you sign with another professional team.

CAN I TERMINATE MY TRAINING AGREEMENT WITH THE CLUB ?

No, but if you refuse and you sign with a different team within the next 3 years, you will have to pay training compensation to your club. You can freely refuse the club’s contract proposal if it has not been transmitted 60 days before the end of the transfer period.

CAN I TERMINATE MY JUNIOR CONTRACT?

Yes, but you will have to pay training compensation to the club if you’re going to sign with another team. It also can be terminated by mutual agreement.

CAN THE CLUB TERMINATE MY TRAINING AGREEMENT ?

Yes but the club must send you a registeied letter at least 30 days before the end of the sporting season. If for some reason you have not signed a contract or a training convention with the next 3 months, the club must allow you to finish school the year after or allow you to find a job opportunity outside of rugby

CAN I TERMINATE MY TRAINING AGREEMENT ?

Yes, you can but it must be notified to the club in written and it will come into force after 30 days. This situation may lead to the payment of training compensation with you sign with an other professional team.

REST PERIODS, VACATIONS, NATIONAL TEAM

AS A PROFESSIONAL RUGBY PLAYER IN TOP14 OR PRO D2, HOW MANY DAYS OF VACATION CAN I HAVE DURING THE SEASON

You accumulate 3 days of holidays per month of work. But be careful, you can’t take these holidays whenever you want. There are specific periods scheduled during the season.

DO I HAVE A BREAK AROUND CHRISTMAS AND NEW YEARS EVE?

Yes. For TOP 14 players: between 17 December 2018 and 6 January 2019 :
4 consecutive days including 25 December 2018 or 3 consecutive days including 25 December and 3 other consecutive days during the period between17 December and 6 January (These days are for all players from the same team)

For PRO D2 players: You must benefit from 11 consecutive days between 24 December 2018 and 3 January 2019 (These days are for all players from the same team)

I'M SELECTED TO PLAY WITH MY NATIONAL TEAM DOES IT CHANGE MY RELATIONSHIP WITH MY EMPLOYER ?

It has no influence whatsoever on your working contract. You’re benefiting from the same rights as an employee of your team and also your club must let you go play for your national team.

CAN I BENEFIT FROM A CHILD BIRTH AND PATERNITY LEAVE ?

Yes, you can benefit from a child birth leave of 3 consecutive days.You’re paid during that period. It can’t be taken whenever you want. You can benefit from an 11 days paternity leave or 18 consecutive days in case of multiple children. During this period you will not be paid. You must inform your employer at least one month in advance

I AM PRO D2 PLAYER, AM I ENTITLED TO ADDITIONAL PERIODS OF PAID LEAVE ON TOP OF THE CHRISTMAS BREAK ?

Yes, each player shall benefit from the following vacation periods:

  • 1 Week set individually or collectively within each club, between 27 August 2018 and 28 April 2019.

In addition, each Top 14 Player may also benefit from the following periods of leave:

  • a period relating to the possible taking of early holidays, between 1 July 2018 and 19 August 2019 inclusive
  • a period relating to the balance of the holidays of the current season, between the end of the official club competitions and June 30, 2019

I AM A TOP 14 PLAYER, AM I ENTITLED TO ADDITIONAL PERIODS OF PAID LEAVE ON TOP OF THE CHRISTMAS BREAK ?

Yes, each player shall benefit from the following vacation periods:

  • 1 Week set individually or collectively within each club, between 20 August 2018 and 31 December 2018.

In addition, each Top 14 Player may also benefit from the following periods of leave:

  • a period relating to the possible taking of early holidays, between 1 July 2018 and 19 August 2019.
  • a period relating to the balance of the holidays of the current season, between the end of the official club competitions and 30 June 2019

AM I ENTITLED TO A VACATION PERIOD AFTER THE LAST OFFICIAL GAME OF THE SEASON ?

Yes, after your last official game of the season you must benefit from 4 consecutive weeks of rest without reporting to your team.
FOR INTERNATIONAL PLAYERS: There are particular provisions in the collective agreement for you. Contact us directly for more details.

HEALTH, INSURANCE PROVISIONS

HOW LONG DO I HAVE TO UNDERGO ALL THE MANDATORY MEDICAL EXAMS WITH THE CLUB?

You must take all the mandatory medical exams as soon as you meet up with the team. You will be able to practice with the team only after completing those medical exams

WHAT HAPPENS IN CASE OF AN INJURY ?

During the first 28 days, the Club will complete the amount of daily social security allowances, which means you will receive the equivalent of your full salary. After the 29th day you will be entitled to the collective agreement benefits limited to 80% of your gross monthly salary and at 6 times the ceiling of social security contributions (19,866 euros gross monthly in 2018). Be careful, if you earn more than 19,866 it is advisable to take an additional insurance coverage .

IF THE DOCTOR DECLARES ME INELIGIBLE TO PLAY FOR MEDICAL REASONS, DO I HAVE AN OPTION ? WHAT IS THE PROCEDURE TO HAVE A SECOND OPINION?

Yes. You can request a second medical opinion from an independent doctor appointed of the LNR.

IF I AM SERIOUSLY INJURED DURING THE SEASON AND HAVE TO STOP PLAYING RUGBY WHAT HAPPENS ? DO I GET ANY MONEY?

The collective agreement offers you specific insurance provision if you can no longer work as a professional rugby player. You will receive benefits according to your age as follows :

  • Players under 25 years of age: 80 % of your gross salary paid for 24 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 250 000 € max.
  • Players from 25 to 27 years of age 80 % of your gross salary paid for 18 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 170 000 € max.
  • Players from 28 to 30 years of age 80 % of your gross salary paid for 12 months as soon as you have been declared ineligible to play for medical reason by the social security doctor. The amount you will receive can be up to 127 500 € max.
  • Players from 31 to 32 years of age 80 % of your gross salary paid for 9 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 85 000 € max.
  • Players from 33 to 34 years of age 80 % of your gross salary paid for 6 months as soon as you have been declared ineligible to play for a medical reason by the social security doctor. The amount you will receive can be up to 42 500 € max.

IF I DIE, WILL MY FAMILY BE ENTITLED TO AN INSURANCE PAYMENT ?

Yes, your family will benefit from an amount that is equal to 100% of your annual gross salary. It will automatically increase by 50% is you were married at the time and will also automatically increase of another 50% for each of the children you are responsible for.

TRANSFER OF PLAYERS

CAN I PLAY AS A MEDICAL JOKER DURING THE SEASON?

Yes, you can be recruited as a “medical joker” until 14 April 2019 even if you have played for another LNR team during the same season.

CAN I BE RECRUITED AS A "COMPLEMENTARY PLAYER" DURING THE SEASON

Yes, you can be recruited as a “complementary player” until 31 December 2018 even if you have played for another LNR team during the same season. Each team can add up to two “complementary players” per season. It changes to 3 for teams who recently move up division.

CAN I BE RECRUITED AS AN "ADDITIONAL PLAYER" DURING THE SEASON?

Yes you can, until the end of January even if you played French championship matches for the current season in another club; clubs can recruit one additional player to replace a player from the French National team. Replacements are limited to 3 per season.

AS TOP 14 OR PRO D2 PLAYER WHAT ARE THE CONDITIONS TO GO PLAY FOR A FEDERAL 1 TEAM?

If you have participated in the competition organized by the LNR you must follow certain conditions: having a full-time professional contract with the team or a professional contract where you are making at least 1000€ gross per month and the proof that you have another activity on the side.

AS A PLAYER WITH A JUNIOR CONTRACT WHAT ARE THE CONDITIONS TO JOIN A FEDERAL 1 TEAM?

If you have participated, in LNR competition with a junior contract (Espoir) you must meet certain criteria to play for a federal 1 team :

  • you must have at least a part-time contract
  • you must have a part-time contract as a professional player and another activity on the side.

CAN I SIGN A CONTRACT WITH A LNR CLUB AFTER PLAYING IN AN AMATEUR COMPETITION?

Yes, an amateur player can sign with no particular condition for an LNR club.

CAN MY CLUB DECIDE TO LEASE ME TO ANOTHER TOP 14 OR PRO D2 TEAM?

Yes, it’s possible but not without your agreement.

I'M NOT A FULL TIME PROFESSIONAL RUGBY PLAYER CAN I BE LEASED TO AN OTHER LNR TEAM

Yes until 14 April 2019. During that period you will benefit from the same salary unless there is a special agreement between your former club and your future club during the lease time.

I'M A TOP 14 OR PRO D2 PLAYER, CAN THE CLUB LEASE ME TO A FEDERAL 1 CLUB?

Yes until 30 September but only under two mandatory conditions : 5 years of FFR licence and being older than 24 years old.

I HAVE A YOUTH PLAYER CONTRACT (ESPOIR) CAN I BE LEASED TO A FEDERAL 1 CLUB

Yes, you can be leased until 14 April 2019 if the club has a training center for youth players.

DUAL CAREER AND TRANSITION

CAN I ASK FOR FINANCIAL SUPPORT IN ORDER TO PREPARE MY AFTER RUGBY CAREER PLAN?

Yes, if you have played in the LNR you’re eligible to request a financial contribution from the C.A.R. You must meet 2 criteria :

  • be a current LNR player
  • have stopped your LNR career for less than 2 seasons.
